This Privacy Policy (the “Privacy Policy”) applies to information that we collect through our websites, mobile applications, and connected products and services (collectively, the “Websites”), in our stores, at events, and through our customer service channels. This Privacy Policy describes the personal data we collect, and explains why we collect it, how we use it, and when we share it with third parties. Our Privacy Policy also describes the choices you can make about how we collect and use your personal data.

2. WHO WE ARE

We are Group Authentic LLC, as well as our family of affiliated companies that operate the brand Authentic Bats (collectively “Authentic Bats,” “we,” “us,” or “our”).

If you are located in the United States, the Authentic Bats company that is responsible for your information under this Privacy Policy is Group Authentic LLC, with an address of PO Box 371, Wynnewood, PA 19096.

3. PERSONAL DATA WE COLLECT FROM YOU

We, or our vendors, may collect your personal data in a number of ways and for various purposes. Such personal data we collect may include the following:

  • Name
  • Billing and shipping address
  • Telephone number
  • Email address
  • Date of birth
  • Purchase information and preference information

You may provide us with personal data when you:

  • Make an online purchase on one of our Websites.
  • Create an account on one of our Websites.
  • Participate in a survey, sweepstakes, promotions.
  • Call, email, or chat with customer care.
  • Post a comment on one of our Websites.
  • When you sign up to receive promotional emails, texts, and other communications from Authentic Bats.

4. PERSONAL DATA WE COLLECT BY AUTOMATED MEANS

Cookies: Cookies are files that contain information about your general Internet usage and are stored on the hard drive of your device. From these cookies, we, or our vendors, may collect information about your browser, including your IP address, operating system and browser type, for system administration. Cookies help us to improve our Websites and to deliver a better and more customized service. They enable us to:

  • Estimate usage numbers and patterns;
  • Store information about your preferences;
  • Customize our Websites according to your individual interests;
  • Speed up your searches; and
  • Recognize you when you return to our Websites.

You may refuse to accept cookies by activating the setting on your browser that allows you to refuse the setting of cookies. However, if you select this setting you may be unable to access certain parts of the Websites or to avail yourself of some of our services and may receive advertisements or other content that are not tailored to your interests. Unless you have adjusted your browser setting so that it will refuse cookies, our system may issue cookies when you log on to our Websites. Additionally, if a browser is set to issue a “do not track” signal, we do not place tracking cookies on that browser. However, some third parties who place cookies on our Websites does not respond to such “do not track” signals, as the online community has not reached a consensus as to Do Not Track standards, implementations and solutions.

Other Tracking Technology: We may also use “pixel tags” and other tracking technologies (sometimes called “Internet tags”, “web beacons” or “clear GIFS”), which are tiny graphic images, on our Websites. Pixel tags help us analyze our customers’ online behavior and measure the effectiveness of our Websites and our advertising. We work with service providers that help us track, collect, and analyze this information. Pixel tags on our Websites may be used to collect information about your visit, including the pages you view, the features you use, the links you click, and other actions you take in connection with the Websites. This information may include your device’s IP address, your browser type, your operating system, date and time information, and other technical information about your device. We may also track certain information about the identity of the website you visited immediately before coming to our site.

Analytics Tools: We may also engage other tracking technology services for analytic purposes, such as Hotjar and Google Analytics, to help us understand how visitors use our Websites.

5. USE OF YOUR PERSONAL DATA

We use the information we collect from our customers for various purposes, including to:

  • Process transactions;
  • Send communications to you about our products, services, promotions, offers, news, and events
  • Serve advertising and offers to you based on your interests and online activities, from us or third parties;
  • Improve our stores, Websites, events, customers shopping experience, and quality of service;
  • Determine the amount, location and frequency of customer traffic into our stores;
  • Prevent and detect fraud and abuse;
  • Process information or claims in connection with incidents at our stores;
  • Enable our service providers to perform certain activities on our behalf;
  • Respond to requests for information or services;
  • Communicate with you about changes to our Websites;
  • Comply with our legal obligations, policies, and procedures; and
  • Otherwise for internal administrative and analytics purposes.

If you have provided personal data to us through more than one method, for example, in store and online, we may combine such information for the purposes identified above.

6. OTHERS WITH WHOM WE MAY SHARE YOUR PERSONAL DATA

We will not sell your personal data to any third party for monetary consideration. We may provide your information to others as detailed below.

We may disclose your personal data to companies that help us bring you the products and services we offer. For example, we may disclose your personal data to service providers and vendors that assist us as follows:

  • To manage a database of customer information;
  • To distribute emails;
  • To distribute other marketing materials or advertisements, including on our Websites and the websites of third parties;
  • To operate our stores in certain jurisdictions;
  • To provide data storage and/or analytics;
  • To prevent fraud;
  • To provide customer service;
  • To provide other services designed to assist us in providing products and services to you.

We require that these vendors agree to keep confidential all information we provide them and to use the information in a manner consistent with this Privacy Policy.

We may share data in aggregate form and/or in a form which does not enable the recipient of such data to identify you (for example, for industry analysis).

In the event of a corporate reorganization, asset transfer, or change of control, your personal data may also be transferred. However, use of your personal data will remain subject to this Privacy Policy.

We may also disclose your personal data when legally required to do so, to cooperate with legal proceedings, law enforcement, court orders, laws, regulations, or other legal obligations, or to assist in an investigation, to protect and defend our rights and property, or the rights or safety of third parties, to enforce our Terms of Use, this Privacy Policy, or agreements with third parties, for crime-prevention purposes, or to protect against misuse or unauthorized use of our Websites.

7. LINKS TO OTHER WEBSITES

Our Websites may include links to third party websites whose privacy practices may differ from ours. If you provide personal data to any of those third parties, it will be governed by their privacy policies, and we encourage you to read those privacy policies carefully before providing your personal data.

8. REMOVAL FROM MARKETING LIST

To be removed from our marketing list, please email us at privacy@AuthenticBats.com, or simply click the unsubscribe button found at the bottom of any of the emails that we send you. If you have set up “My Account,” you can also go to the “email preferences” section of your account and modify your subscription settings. Please allow us at least ten (10) business days from when the request was received to complete the removal, as some of our promotions may already be in process before you submit your request.

9. MAINTENANCE AND PROCESSING OF PERSONAL DATA

Your personal data may be stored, transferred and processed in and to the United States and in other countries by our affiliates and/or service providers. The data protection laws in these countries may provide a lower standard of protection for your personal data than your country of residence. We take great care in protecting your personal data and have put in place adequate mechanisms to protect it when it is transferred internationally. We will transfer your personal data in compliance with applicable data protection laws and will implement suitable safeguards to ensure that your personal data is adequately secured by any third party that will access your information.

By using our Websites and providing personal data to Authentic Bats, you acknowledge the terms of this Privacy Policy and the collection, use, maintenance, transfer to and processing of your personal data in the United States or other countries or territories.

10. SECURITY

Authentic Bats uses commercially reasonable measures to keep your personal data private and safe. We take appropriate physical, electronic and administrative steps to maintain the security of personal data we collect, including limiting the number of people who have physical access to our servers, as well as employing electronic security systems and password protections that guard against unauthorized access.. Our customer care center and stores operate over private, secure networks.

We use commercially reasonable security technology in transferring information to process your orders. All payment card transactions should take place in protected areas of our Websites, which are designed to reduce the risk of any loss, misuse or alteration of the information collected. When you begin the checkout process, you should move into such a protected area. Once you’ve entered, the page address (URL) should change from “http” to “https.” Also, a key or a closed lock should appear in the lower right hand corner of your screen to notify you of this change. You should remain in this secure zone for the entire checkout process. Please check that you are still in this protected area when you type in your payment card details.

Despite our best efforts, the transmission of data over the Internet cannot be guaranteed to be 100% secure. While we use commercially reasonable means to ensure the security of information you transmit to us, we cannot guarantee that such information will not be intercepted by third parties. We may, however, prosecute any unauthorized or fraudulent transactions to the fullest extent permitted by law.

11. CALIFORNIA AND OTHER REGION SPECIFIC-DISCLOSURES

11.1 APPLICABLE UNITED STATES PRIVACY NOTICE:

This section describes how Authentic Bats processes the Personal Information or Personal Data of California, Colorado, Connecticut, Utah, and Virginia residents (collectively, the “Applicable States”). For the purpose of this notice, Personal Information applies to “Personal Information” as defined by the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act of 2020, and “Personal Data” as defined by the Colorado Privacy Act (“CPA”), the Connecticut Data Privacy Act (“CTDPA”), and the Virginia Consumer Data Protection Act (VCDPA)  (collectively “Applicable State Privacy Laws”. This Notice does not cover information that is outside of the scope of the Applicable State Privacy Laws. This notice also does not apply to data collected from employees, applicants, and contractors.

We collect Personal Information directly from you, your device or browser, our service providers and suppliers, and our corporate affiliates.

In addition to the uses and disclosures of Personal Information described in the chart above, we may use and disclose any personal information as reasonably necessary to comply with law and legal requirements, cooperate with and respond to law enforcement requests, or as otherwise required by applicable law, court order, or governmental regulations. We also use Personal Information we collect as necessary to maintain appropriate records for internal administrative purposes, to protect our rights and interests or those of others, to resolve any disputes, to enforce our policies, or to prevent harm. Any Personal Information we collect may be provided to our professional advisors, including accountants, auditors, consultants, and lawyers, when reasonably necessary for our professional advisors to perform services for us and give us appropriate advice. Any and all personal information we collect may be given to another company in the event of a sale, merger, or other acquisition of some or all of our assets or business or as part of the negotiation or evaluation of such sale, merger, or other acquisition.

We do not use or disclose Sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the Applicable State Privacy Laws.

If you are a resident of any of the Applicable States, you have the right to submit certain requests relating to your Personal Information or Personal Data as described below. To exercise any of these rights, please submit a request to us via email at privacy@AuthenticBats.com or call us at 888-544-2287.  Authorized agent requests must include a copy of the agency agreement between the authorized agent and the consumer. We will ask the consumer to independently confirm the agency relationship. Any request you submit to us is subject to an identification verification process (“Verifiable Request”). This verification process includes providing us at least two (2) unique data points, depending on the type of request. We will not fulfill your request unless you have provided sufficient information for us to reasonably verify you are the Consumer about whom we collected Personal Information or Personal Data. We will typically not charge a fee to fully respond to your requests, but we may charge a reasonable fee, or refuse to act upon a request, if your request is excessive, repetitive, unfounded, or overly burdensome.

11.2 CALIFORNIA AND OTHER REGION SPECIFIC-DISCLOSURES

11.2.1 CALIFORNIA RIGHTS DISCLOSURE

Right to Know: You have the right to know about your Personal Information. You also have the right to obtain a transportable copy of your Personal Information. Your right to know request may be made no more than twice in a 12-month period.

  • The categories of Personal Information we have collected about you
  • The categories of sources from which the Personal Information was collected
  • Our business or commercial purposes for collecting, selling, or sharing your Personal Information
  • The categories of third parties to which we disclosed your Personal Information
  • The categories of Personal Information we sold or shared about you and the categories of third parties to which each category of Personal Information was sold or shared
  • The categories of Personal Information we disclosed about you for a business purpose and the categories of persons to which it was disclosed
  • The specific pieces of Personal Information we have collected about you

Right to Correct Personal Information: You may request that we correct Personal Information that we maintain about you if you believe such Personal Information is inaccurate. Upon receipt of a verifiable request to correct inaccurate Personal Information, we will use commercially reasonable efforts to correct the information as you direct.

Right to Request Deletion of Personal Information: You may request that we delete your Personal Information that we have collected directly from you and are currently maintaining. Please note, however, that we may have a legal basis for retaining Personal Information under the CCPA, despite your request.

Opt-Out Rights: You have the right to opt out of the selling or sharing of your Personal Information via tracking technologies (e.g., cookies) on the Website by clicking on the “Do Not Sell or Share My Personal Information” link in the footer of the Website. To effectively manage cookies via this cookie settings tool, you must set cookie preferences on all browsers and all devices that you use. If you clear the cookies on your device, you may need to set your cookie preferences again. If you choose to use an opt-out browser signal, such as the Global Privacy Control, you will be opted out of cookie-based sales and shares. Please note that visiting our Website with an opt-out browser signal enabled will have the effect of opting you out of the selling or sharing of personal information via tracking technologies (e.g., cookies) on our Website. You will need to turn on the signal for each browser that you use. Right to Limit Use and Disclosure of Your Sensitive Personal Information: We do not use or disclose your sensitive Personal Information to infer characteristics or for other purposes subject to limitation under California law.  Accordingly, there is no need for you to direct us to limit the use and disclosure of your sensitive Personal Information. We will only use or disclose sensitive Personal Information in a manner that is reasonably necessary to provide our goods and services, or as needed: to ensure security and integrity; to prevent fraud or illegal activity; to perform services on behalf of the business; or to verify or maintain the quality or safety of a service controlled by us, or to improve, upgrade, or enhance such services.

Right to Non-Discrimination for the Exercise of Your Privacy Rights: If you choose to exercise any of your privacy rights under the CCPA you also have the right not to receive discriminatory treatment by us.

You may alternatively exercise more limited control of your Personal Information by instead exercising one of the following more limited opt-outs: opting out of marketing emails by clicking the ‘unsubscribe’ link in an email or sending an email to privacy@AuthenticBats.com.

11.2.2 NOTICE OF FINANCIAL INCENTIVES

From time to time, we offer discounts and promotions (“Programs”) that provide benefits to those who choose to participate. Participation requires you to provide some Personal Information, such as Identifiers (e.g., email addresses, phone numbers, and/or zip codes). The full terms and conditions of our Programs will be set forth where the opportunity to sign up is offered.

We have made a good faith estimate that the value of consumers’ Personal Information provided in connection with our Programs is related to the relevant expenses associated with the collection and retention of that Personal Information. By joining our Programs, you consent to any associated financial incentive. You have the right to withdraw from the financial incentive at any time by discontinuing the program in the manner provided.

Unless you specifically request, submission of a request to delete your Personal Information will not erase information required for you to continue to participate in our Programs. Should you wish to delete your Personal Information associated with our Programs (and thereby cancel your participation in the program), please contact us at privacy@AuthenticBats.com. In addition, we may offer you financial incentives for the collection, sale and retention and use of your Personal Information as permitted by the CCPA. The material aspects of any financial incentive will be explained and described in its terms. Please note that participating in incentive programs is entirely optional, you will have to affirmatively opt-in to the program and you can opt-out of each program (i.e., terminate participation and forgo the ongoing incentives) prospectively by following the instructions in the applicable program description and terms. We may add or change incentive programs and/or their terms by posting notice on the program descriptions and terms, so check them regularly.

11.2.3 CALIFORNIA SHINE THE LIGHT

Separately from the CCPA, the California Shine the Light law permits customers in California to request certain details about how their personal information is “shared” with third parties as defined in the Shine the Light law, and in some cases affiliates, if personal information is shared for those third parties’ or affiliates’ own direct marketing purposes. We share personal information with third parties or affiliates for those third parties’ or affiliates’ own direct marketing purposes. Californians may request information about our personal information sharing by contacting us at privacy@AuthenticBats.com.  Please include “California Shine the Light Request” in the subject line and in the body of your message. Please note that “Shine the Light” rights and CCPA rights are granted by different laws and must be exercised separately.

11.3 NEVADA

Under Nevada law, Nevada residents may opt out of the sale of certain “covered information” collected by operators of websites or online services. We currently do not sell covered information, as “sale” is defined by such law.

11.4 OTHER APPLICABLE U.S. STATES

Other Applicable State Privacy Laws Rights Disclosure

We may process your Personal Data for Targeted Advertising (as the term is defined in the Applicable State Privacy Laws). Some of the ways that we disclose Personal Data constitute a Sale (as the term is defined in the Applicable State Privacy Laws).

If you are a Colorado, Connecticut, Utah, or Virginia resident, subject to certain conditions and restrictions set out in the respective state law, you may have the following rights with regard to your Personal Data:

  1. Right to Access. You have the right to request access to and obtain a transportable copy of any Personal Data that we may hold about you.
  2.       Right to Correct. You have the right to request that we correct inaccuracies in your Personal Data.
  3.       Right to Delete. You have the right to request that we delete Personal Data that we have collected from or obtained about you.
  4.       Right to Opt Out of Targeted Advertising. You have the right to request that we stop disclosures of your Personal Data for targeted advertising via cookies and tracking technologies by adjusting your cookie preferences through the “Do Not Sell or Share My Personal Information” link in the footer of this page.
  5.       Right to Opt Out of Sales. You have the right to opt out of our Sales of your Personal Data.
  6.       Right to Opt Out of Automated Processing. We do not engage in “automated processing” in a manner subject to “opt out” under Applicable State Privacy Laws. The right to opt out of automated processing is not applicable to your Personal Data that we process.
  7.       Right to Opt Out of Profiling. We do not engage in “profiling” in a manner subject to “opt out” under Applicable State Privacy Laws. The right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects is not applicable to your Personal Data that we process.
  8.      Right to Appeal. If you are unsatisfied with our actions related to the exercise of one of your privacy rights above, you may have the right to appeal our decision.

Under the Applicable State Privacy Laws you have the right to exercise your privacy rights twice in a 12-month period.  You may do so by emailing us at privacy@AuthenticBats.com.

11.5 EUROPEAN ECONOMIC AREA (EEA) AND THE UNITED KINGDOM (UK):

11.5.3 INTERNATIONAL TRASFERS

We share your personal data with and amongst Authentic Bats entities, including Group Authentic LLC.  This may involve transferring your data outside the European Economic Area (“EEA”) and the United Kingdom (UK). Some of our external third party service providers are also based outside of the EEA or the UK, and their processing of your personal data will involve a transfer of data outside the EEA or the UK. This includes the United States. Where personal data is transferred to and stored in a country not determined by the European Commission or the Information Commissioner’s Office (ICO) as providing adequate levels of protection for personal data, we take steps to provide appropriate safeguards to protect your personal data, including entering into standard contractual clauses approved by the European Commission or an international data transfer addendum approved by the ICO, obliging recipients to protect your personal data.

Authentic Bats will retain your personal data only for as long as necessary for the purposes it was retained, such as to enable you to use the Websites and your products or to provide services to you.
